2. Permitted use
You agree to use the site in good faith, in accordance with the law and these Terms. In particular, you may not: (a) use it for unlawful or fraudulent purposes; (b) attempt to breach its security, gain unauthorized access to systems or data, or interfere with its operation; (c) introduce viruses or other harmful code; (d) submit false, misleading or offensive information, or information that infringes third-party rights; or (e) extract content by automated means without our written authorization.

You are granted a limited, personal, non-exclusive and non-transferable license to view them for your own informational and training purposes. Copying, reproducing, modifying, selling, publishing or distributing them, in whole or in part, without our prior written permission is prohibited.
4. Courses, workshops and resources
Access to courses and downloadable resources is personal and non-transferable, and may not be shared or resold. Courses hosted on our learning platform, as well as workshops contracted by companies, may be subject to additional conditions (price, deadlines, certification, cancellation), which will be disclosed before enrollment or in the corresponding proposal and which, once accepted, become part of these Terms.
5. Educational nature of the content
The content of the site and of our programs is exclusively educational and awareness-oriented. It does not constitute legal, technical, medical or professional advice, nor does it replace compliance with the occupational health and safety and worker protection regulations that apply in each jurisdiction (national, federal, state, provincial or local), or with the policies, procedures and requirements of each employer, regulator or competent authority. Each company and each person is responsible for knowing and complying with the rules that govern their activity and workplace.
The results of a prevention program depend on multiple factors specific to each organization and each person. Therefore, Educalatina does not guarantee the reduction or elimination of accidents, incidents or penalties.
6. Disclaimer of warranties
The site and its content are provided "as is" and "as available". To the maximum extent permitted by applicable law, we do not guarantee that the site will operate uninterrupted or error-free, or that the content is comprehensive, current or suitable for a particular situation.
7. Limitation of liability
To the maximum extent permitted by applicable law, Educalatina, its partners, officers, employees and collaborators will not be liable for direct, indirect, incidental, special or consequential damages, or loss of profits, arising from the use of or inability to use the site, reliance on its content, or decisions made on the basis of it. Nothing in these Terms excludes liability that cannot legally be excluded. If, despite the foregoing, any liability were established against Educalatina, it will be limited, to the extent permitted by law, to the amount actually paid by the user for the service giving rise to the claim.
8. User responsibility
The user is responsible for how they use the site and its content, for the accuracy of the information they provide, for the confidentiality of their access credentials and for the decisions they make in their workplace. The user will hold Educalatina harmless from third-party claims arising from a breach of these Terms or from misuse of the site.
9. Third-party links and services
The site may include links, embedded videos (such as YouTube or Vimeo) and third-party services, which are governed by their own terms and policies. Educalatina does not control and assumes no responsibility for their content, availability or practices.
10. Privacy and cookies
The processing of personal data is governed by our Privacy Policy and the use of cookies by our Cookie Policy, which form an integral part of these Terms.
11. Changes and user responsibility
We may modify these Terms, the site and the services at any time. The current version is the one published on this page, with its update date, and changes take effect upon publication. It is the user's responsibility to review these Terms periodically. Continued use of the site after a change means that you accept it.
12. Severability
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will remain fully in force. Failure by Educalatina to exercise a right does not constitute a waiver of it.
13. Governing law and jurisdiction
These Terms are governed by the laws of the State of Florida and the federal laws of the United States of America, without regard to their conflict-of-law rules, and the competent courts of the State of Florida will have jurisdiction to resolve any dispute, subject to the following: where the user resides in another country or jurisdiction, the mandatory and non-waivable public-order and consumer or worker protection rules of the user's place of residence will also apply, as will any other local law that cannot be excluded by agreement between the parties.
